Rob Kardashian is making waves for recent Instagram posts that make a number of allegations about ex-girlfriend Blac Chyna. After accusing her of cheating on him, Kardashian released a series of graphic and explicit posts that escalate in seriousness all the way to naked photos of someone who appears to be Chyna (though her face is not pictured so it's difficult to prove that the photos are of her). Instagram removed the photos once, and Kardashian re-added them, but they were removed again. While definitely petty, could Rob Kardashian be sued for sharing nude photos of Blac Chyna? California laws may enable Chyna to take him to court. Kardashian's representative has not responded to Romper's request for comment.
In one of the posts, Kardashian shared a video of Chyna allegedly kissing another man, along with a message to her:
Hahahaha Chyna just sent me this video saying happy 4th of July what a crazy person. Come spend time with your daughter instead of f—ing me and then this dude right after. U need help.
He also shared photos of a text conversation between himself and the man he alleges Chyna is seeing:
This is the dude Chyna got caught cheating on me with for a minute now. And look he texted me asking for help and said he needed money cuz he can’t afford to pay Chyna’s bill so that’s why I pay her bills. More receipts are coming. Just yesterday Chyna sent me her p— and everything and said she gonna come f— me … wait for it. Never once have I cheated on Chyna and I remained loyal to her even after all the cheating she been doing and the multiple men she been f—ing including me.
Perhaps most shockingly, Kardashian shared a screenshot of his messages with Chyna that included a photo of what he claims are Chyna's exposed genitals:
This is from Chyna yesterday to me. I never been so disrespected in my life. I just bought her 250K of jewelry yesterday. This woman is so disrespectful and I don’t care.
Many of these photos have since been removed, although it is unclear whether they were taken down by Instagram or by Kardashian himself.
Screenshots and videos aren't all that Kardashian shared; he also made a slew of allegations about Chyna's character and behaviors, including allegations of drug abuse. If any of these allegations are proven to be false and result in damage to her reputation, Chyna could have grounds to sue for defamation.
In addition to legal proceedings brought about by Chyna, Kardashian may face charges from the state of California. Posts of nude photos such as this — when shared without the permission of the person photographed — constitute revenge porn. According to the Cyber Civil Rights Initiative, 38 states and Washington, D.C., have laws in place to prevent and prosecute revenge porn - including California.
These laws provide victims with the means to protect and defend themselves from posts such as Kardashian’s. California classifies revenge porn as a “Disorderly Conduct Misdemeanor.” The penalty for misdemeanor disorderly conduct in California is up to one year in jail as well as fines.
Whether they come from the state or from Chyna herself, the consequences of Kardashian's actions are likely to come back to haunt him. Regardless of what is going on between the two of them, Kardashian crossed a line — both moral and legal — when he posted to Instagram.
